NPBA Privacy Policy

This Privacy Policy discloses the privacy practices of the Norfolk & Portsmouth Bar Association (the “NPBA”) for this website, social media platforms, webinar offerings, mobile applications, electronic communications, digital photographs, and any other related digital services or platforms officially operated or used by the NPBA from time to time (together referred to as our “Sites”), as well as all other products and services offered by the NPBA.

The NPBA reserves the right at its sole discretion to update this Privacy Policy at any time and for any reason. Unless otherwise stated, such changes, modifications, additions or deletions shall be effective immediately upon posting to any of our Sites or by email notice to the email address listed by registered users. You acknowledge and agree that it is your responsibility to maintain a valid email address as a registered user and review this Privacy Policy periodically to be aware of any modifications.

You must be at least 18 years old to have our permission to use our Sites. We do not knowingly collect personal information from or market to children under the age of 13.

You acknowledge that this Privacy Policy is part of the terms and conditions for use of our Sites, and by accessing or using our Sites in any manner, you agree to be bound by all of the applicable terms and conditions. If you do not agree to the applicable terms and conditions, please do not access or use our Sites.

1. Types of Information Collected

Personal Data

We collect information (whether online, by phone, or by paper) that enables the NPBA to identify or contact you (“Personal Data”) to carry out its business purposes. When you use our Sites or engage in various activities of the NPBA (such as applying for membership, registering for an NPBA event or program, purchasing NPBA products or services, submitting content, filling out a survey, providing feedback, or otherwise interacting with the NPBA) we may ask you to provide certain Personal Data. It is completely optional for you to engage in these activities and to provide us with any Personal Data; however, if you do not provide certain mandatory data with respect to a particular activity, you may not be permitted to engage in that activity.

The types of Personal Data we collect include, but are not limited to: general data (e.g., names, dates of birth, home/business addresses, email addresses, and mobile/office/personal telephone numbers that are provided by our members); professional data (e.g., bar pass date and state, law license number, employer, job title, law practice areas); and other identification information (e.g., photographs). The NPBA also receives Personal Data from third parties for our use in marketing to potential new members, such as lists of new state bar admittees from the Virginia State Bar.

Non-Personal Data

Also, we collect information that does not directly identify you as you interact with our Sites (“Non-Personal Data”). The types of Non-Personal Data we collect include, but is not limited to: usage of our Sites (e.g., browsing history, search terms, number of clicks, referring/exit pages, date/time stamp, time on Sites); products and services viewed, including advertisements for such products and services; computer type, operating system and platform type; and internet service provider and IP address.

2. Use of Information

The NPBA primarily uses your Personal Data and/or Non-Personal Data to provide our products and services to you, improve our marketing and promotional efforts, statistically analyze and improve performance of our Sites, and deliver administrative notices.  In addition to the uses described above, the NPBA may use your Personal Data and/or Non-Personal Data, in a variety of ways including, but not limited to: identify you when you visit our Sites; provide service communications such as membership renewal reminders, order confirmations, program registrations and customer service messages; provide products, information and services you request or that we think you may be interested in; respond to your requests for products, services, or information; deliver and process surveys; personalize and improve the usability of our Sites; fulfill and/or deliver NPBA products and services; tailor content, advertising and marketing to you; publish membership directories, membership lists and registration lists on our Sites and in print and digital media to allow lawyers and the public to find you.

3. Release of Information

The NPBA my share your Personal Data, sometimes combined with Non-Personal Data, in a variety of ways including, but not limited to the below:

·        Share data with third parties to fulfill service requests and to perform business functions (e.g., the NPBA may utilize third parties to provide services on our behalf such as data hosting services; packaging, mailing and delivering services; customer support and consulting services; webinars and event registration services). 

·        Share data with third parties as required by law or to protect the NPBA in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on the NPBA; (b) protect and defend the NPBA’s rights or property; or (c) protect the personal safety of NPBA personnel, members, or the public in appropriate circumstances.

·        Share data with third parties to offer you products and services that may be of interest to you professionally or personally (e.g., membership renewal notices, products and services, business software solutions, or member product discounts).  These third parties may include social media sites such as Facebook, LinkedIn, Twitter and others who may contact you with “targeted ads” relating to legal and other services.  Users can request their information to be removed from such lists by contacting us as set forth in the “Contact Information” section below.

·        Share data with third parties to send periodic emails to you. If at any time you would like to unsubscribe from receiving our emails, you can follow the detailed unsubscribe instructions at the bottom of each email or you may contact us as set forth in the “Contact Information” section below.

·        Share photographs that include you taken at NPBA events or in connection with NPBA activities.  Such photographs may be published in newsletters disseminated by NPBA, posted on social media accounts utilized by NPBA, etc.

·        Make data visible to other attorneys, others who have interest in the legal profession and NPBA events, as well as the public through NPBA membership directories, membership lists and registration lists.

·        Share data with third parties under other unanticipated situations, but only with your consent.

4. Managing, Updating and Correcting Information

Registered users may log into their member profile account (with the assigned username and password) to update/ correct some portions of their Personal Data and in certain circumstances, update the visibility of their Personal Data. You may also update correct this personal information and privacy preferences by contacting us as set forth in the “Contact Information” section below.

We encourage you to promptly update your Personal Data if it changes. Also, you may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, we may not be able to delete information associated with past transactions. In addition, it may be impossible to completely delete your information without some residual information because of associated reports, linked accounts, and backups.

Our processing of your Personal Data is based upon your consent, contract performance (e.g., your purchase of products or membership sign-up/renewal), legitimate business interest (e.g., direct marketing of goods and services), or compliance with law.  You have the right to object to our processing of your Personal Data or to restrict our processing of that data. In addition, if you have consented to the processing of your Personal Data, you have the right to withdraw your consent at any time.

5. Security and Protection of Information

The importance of security for your Personal Data is of utmost concern to us. So, we implement commercially reasonable security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data.

In order to most efficiently serve you, credit card transactions and order fulfillment are securely handled by established third party banking, processing agents and distribution institutions. They receive the information needed to verify and authorize your credit card or other payment information and to process your order.

Unfortunately, no data transmission over the Internet or electronic storage is fully secure. Accordingly, and despite our reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, the NPBA cannot guarantee or warrant the security of the Personal Data you transmit to us, or to or from our Sites.

The safety and security of your Personal Data also depends on you.  You are responsible for safeguarding the username and password associated with your member profile account and notifying us immediately if you suspect the account has been compromised.

6. Cookies

When you use our Sites, we may store cookies on your computer in order to facilitate and customize your use of our Sites. A cookie is a small data text file, which a website stores on your computer’s hard drive (if your web browser permits) that can later be retrieved to identify you to us. For example, our cookies may store randomly assigned user identification numbers, the country where you are located, and your first name to welcome you back to our Sites. The cookies make your use of our Sites easier, make our Site run more smoothly and help us to maintain a secure site.

You are always free to decline or restrict cookies to the extent your browser permits. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Sites may not work properly in your case.

7. Third Party Sites

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. You may find advertising or other content on our Sites that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors, or other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by such third parties nor should we be deemed to have endorsed or recommended such third parties. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Sites, is subject to that website’s own terms and policies. 

You should also be aware that when Personal Data is voluntarily disclosed in discussion forums, chat rooms or other public areas, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information. Any submissions to those public areas are accepted with the understanding that they are accessible to all third parties. If you do not want your comments to be viewed by third parties, you are advised not to make any such submissions. Ultimately, you are solely responsible for the privacy of any information you disclose in a public forum. Please be careful and responsible whenever you’re online.

8. Disclaimer

The NPBA does not warrant the accuracy, reliability or timeliness of any information published by our Sites, nor endorse any content, viewpoints, products, services, or advertisements linked from our Sites, and shall not be held liable for any losses caused by reliance on the accuracy, reliability, or timeliness of such information. Portions of such information may be incorrect or outdated. Any person or entity who or which relies on any information obtained from our Sites does so at his/her/its own risk.
