Title: “A Haunted House of Procedural Default: Spooky Ways to Hurt (or Lose) Your Appeal at Trial”

Summary:

  • The expansion of the Court of Appeals and the new right of appeal for civil litigants in Virginia courts requires litigators to be cognizant of how things done or not done at trial may affect a future appeal
  • The presentation will focus on several areas where civil litigators may foreclose issues for an appeal or an appeal altogether by doing such things as failing to preserve error properly or waiving issues
  • It will also focus on technical aspects that are important including ensuring that there is a sufficient record on appeal and that proper timing and procedure is followed in noting an appeal and in posting the appropriate appeal and suspension bonds
